Exhaustion of Domestic remedies — Held: Legal or Natural persons in member states must exhaust local remedies in accordance with Article 26 of the Treaty in the instant case there was no exhaustion of domestic remedies because the applicant had withdrawn a case before the Kenyan High Court just before filing the case in the COMESA Court of Justice.
