Exhaustion of Domestic remedies — Held: As a private party, MML rightly brought the matter to the Court on the basis of Article 26 of the Treaty, which provides access to the Court by natural and legal persons resident in COMESA Member States. The applicant had therefore exhausted local remedies as required by the Treaty after the delivery of final judgment by the highest court in Malawi – the Supreme Court of Appeal.
