Injunction – Suspension of a Measures by member States — Held: the grant of an injunction pending appeal is not as a matter of course. The grant is discretionary. The discretion must be exercised both judiciously and judicially. The Court in exercising its discretion must consider the balance of the competing interests and the rights of parties to do justice to the case because the effect of the order is to deprive the successful party the profits of his judgment.
