Directive relating to Regional Councils and Local Authority Councils

Government Notice 104 of 2020

Under regulation 14(1) and (3) of the State of Emergency - Covid-19 Regulations published under Proclamation No. 9 of 28 March 2020, with the authorisation of the President and the approval of the Attorney General, I issue the Directive set out in the Schedule.E. UutoniMinister of Urban and Ruaral Development

1. Definitions

In this directive a word or expression to which a meaning has been assigned in the State of Emergency - Covid-19 Regulations has that meaning, and unless the context otherwise indicates-"local authority area" means a local authority area as defined in section 1 of the Local Authorities Act, 1992 (Act No. 23 of 1992);"local authority council" means a local authority council as defined in section 1 of the Local Authorities Act, 1992 (Act No. 23 of 1992);"potable water" means water that is treated and safe to drink or to use for food preparation;"region" means a region as defined in section 1 of the Regional Council Act, 1992 (Act No. 22 of 1992);"regional council" means a regional council as defined in section 1 of the Regional Council Act, 1992 (Act No. 22 of 1992); and"the Regulations" means the State of Emergency-COVID-19 Regulations published under Proclamation No. 9 of 28 March 2020.

2. Provision of potable water

(1)Local authority councils must ensure that residents within its respective local authority areas-
(a)with arrears and suspended water services have their water supply reconnected; and
(b)with no access to water supply are provided with access to potable water.
(2)Regional councils must ensure that the residents within the area of jurisdiction of the respective regional councils-
(a)with arrears and suspended water services have their water supply reconnected; and
(b)with no access to water supply are provided with access to potable water.
(3)All costs incurred in supplying water, as directed in paragraph (1) and (2) and as a result ofthe lockdown, must accurately be recorded.
(4)The costs referred to in paragraph (3) must be ring-fenced and kept separate from the normal operational water bills.
