DARE & Others v Saunyama N.O. & Others AND Zimbabwe Divine Destiny v Saunyama & Others (HH 589-16 HC 9469/2016 HC 8940/2016 HC 9470/2016) [2016] ZWHHC 589 (04 October 2016)

The 1st respondent, the police officer commanding Harare District, issued a notice in terms of section 27(1) of the Public Order and Security Act [Chapter 11:07] (POSA) in terms of which he banned for a period the holding of all public processions and demonstrations in the Central Business District of Harare, for two weeks.

This application challenged the validity of the statutory instruments which held that all public processions and demonstrations were temporarily banned.

This was an application in terms of article 50 of the Constitution to enforce the rights to protection under the law, fair hearing and work, and freedoms of expression, assembly, association and conscience guaranteed under articles 21(1), 28(1), 29 and 40(2) of the Constitution, respectively.

Kiiza Besigye v Civil Aviation Authority & Anor (Civil Suit 732 of 2016) [2019] UGHCCD 39 (15 March 2019);

The plaintiff was arrested by the Ugandan Aviation Police (AVPOL) at Entebbe Airport while on his way to meet his political supporters. He sought declarations that the defendants, the Civil Aviation Authority (1st defendant) and the Attorney General (2nd defendant) violated his right to freedom from torture, cruel, inhuman or degrading treatment or punishment; the right to freedom of movement, assembly and association as guaranteed in articles 20, 24, 29 and 50 of the Constitution of Uganda.
