DECISION ON THE ACTIVITY REPORT OF THE AFRICAN
COURT ON HUMAN AND PEOPLES’ RIGHTS

The Executive Council,

1. TAKES NOTE of the Report of the African Court on Human and Peoples’ Rights (AfCHPR) for the period January to May 2011 and the recommendations contained therein, as well as the activities undertaken by the Court during the period under consideration;

2. REQUESTS the immediate implementation of the 2011 budget of AfCHPR with regards to the status of Judges;

3. REQUESTS the Permanent Representatives’ Committee (PRC) through its Sub- Committee on Structural Reforms to consider the Court’s proposal on the new structure of its Registry and submit appropriate recommendations for consideration by the Executive Council at its next session in January 2012;

4. REITERATES its appeal to Member States which have not yet done so to sign and ratify the Protocol on the Establishment of the African Court on Human and Peoples’ Rights;

5. INVITES States Parties to the Protocol, which have not yet done so, to make the declaration accepting the jurisdiction of the Court to receive applications from individuals and non-governmental organizations, and allow them access to the Court, after they have exhausted national remedies;

6. ENCOURAGES AfCHPR and the African Commission on Human and Peoples’ Rights (ACHPR) to work in close collaboration in their respective mandates to promote and protect human rights on the continent;

7. REQUESTS the Commission in collaboration with AfCHPR to finalize the process of examining the implications of AfCHPR being empowered to try international crimes and report thereon to the Assembly, through the Executive Council in January 2012.
